The plates prepared by the chef are copyrighted. This means that the creator of the work (i.e. the chef) determines where and how the image may or may not be used.
Beautifully prepared dishes
Some chefs believe that their creations should not be shared on Instagram unsolicited. Your beautiful food photo on Instagram may just be illegal. The more complicated the layout of the dish, the greater the chance that copyright applies.
No claims yet
So far, no claims have been made by chefs, but that could be, according to Die Welt. The person who posted the photo could then be fined.
For and against
Whether it is smart or not, opinions differ. Some think it's a good thing if smartphones are not on the table during dinner. Others find photos on Instagram a good form of advertising for the restaurant. And what does beautifully prepared dishes matter if no one comes to enjoy them in the restaurant?
